LOUISIANA 70118 FEBRUARY 23, 1990 Judge dismisses defamation charge By Dan De Leo Assistant News Editor Civil District Court Judge Thomas Early dismissed defamation charges Jan. 26 brought by Beverly Murphy against Loyola University and Donald G. Rizzo, vice president for Institutional Advancement. Loyola and Rizzo are named as defendants in Beverly P. Murphy v. Loyola University and Donald G. Rizzo, according to a petition filed in civil district court Sept. 21, 1989. The lawsuit concerns the April 19,1989 termination of Murphy, the plaintiff, from her position as director of Alumni Affairs at Loyola. Her lawsuit alleges defamation, wrongful termination and intentional infliction of emotional distress. The defamation charge was based on Murphy's claim that Rizzo "willfully, maliciously, and recklessly informed personnel at the Loyola University Personnel Office that [Murphy] was being terminated for her refusal to perform [Reunion Giving]," a fund-raising campaign, the lawsuit claims. In the lawsuit, Murphy claims that Rizzo "never asked, requested, demanded, implied, or in any manner suggested that [Murphy] should undertake Reunion Giving." 'The falseand reckless representations made by [Rizzo] to the Personnel Office and to others as the basis for [Murphy's] termination slandered and defamed [her] character, reputation, and longstanding record of outstanding performance at Loyola University," the lawsuit claims. Defendants Loyola and Rizzo denied the allegations of defamation. Loyola moved for and was granted dismissal of the defamation charge based on qualified immunity exception, that Rizzo had an obligation to pass on information he believed to be true, Michael J. Mestayer, attorney for Murphy, said. Rizzo was not in town and was unavailable for comment. Murphy's wrongful termination claim is based on her allegations that Rizzo fired her without following correct procedures. "[Rizzo] ... intentionally refused to follow any of the procedures mandated by the Loyola Personnel Policies and Procedures Manual, and instead, terminated [Murphy] without any verbal or written warning, and without Carter reports on Salvadoran Jesuit killings By Elizabeth Mehaffey News Editor The Salvadoran investigation into the Nov. 16 murder of six Jesuits has been effective in identifying the gunmen, but has not adequately established who gave the orders, the Rev. James C. Carter, S.J., university president, said Monday. Carter returned last week from a three-day visit to El Salvador. He was part of a six-person delegation from the Association of Jesuit Colleges and Universities sent to evaluate the progress of the Salvadoran investigation into the killings. "I think the investigation unit has done a marvelous job of identifying who pulled the triggers," Carter said, "but we're not satisfied in terms of intellectual authorship — who did the planning, who gave the orders." Carter said the delegation visited El Salvador in order to show support of the Jesuits in El Salvador, to look around at Central American University, the university at which the six murdered Jesuits taught and lived, and to look at the status of the investigation of those Jesuits' murders.
